REGULAR COUNCIL MEETING MINUTES =

THURSDAY, JANUARY 10, 2008

7:30 PM

CALL TO ORDER - With the Pledge of Allegiance= and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.=

ROLL CALL - Present were Messrs. Frank Sommerkamp, Thomas Moser, David Kramer, Ralph Laird, and David Thiel as was= Mrs. Colleen Collins Bright. =

APPROVAL OF AGENDA – Mayor Meier noted that Officer Jim Miller wished to address council on the potential implementation of an Explorers program post through the LPCVHPD a= nd shall do so under “Citizens and Guests.”

May= or Meier also desired amendment of item E under NEW BUSINESS – “to go in= to executive session pursuit to KRS 61.810 section 1, item c for discussion of delinquent property taxes.”

Approved as amended.<= o:p>

APPROVAL OF MINUTES – Mr. Kramer stated that Mich= ael Paolucci’s name was misspelled under the Police Authority committee report, and that he desired specific notation of the promotions of Detectiv= es Russell Leberecht, and Bradford Dagenhardt to Sergeant.

CITIZENS AND GUESTS

Off= icer Jim Miller introduced Kelly McIntosh Crow, and both proceeded to present backgr= ound information on the Explorer’s program, which is hosted through the Dan Beard Council of Boy Scouts, although male and female applicants are accepted. The program teaches skills needed in the law enforcement field, such as patrol procedures, traf= fic control and radar operations, accident investigation, criminal and crime sc= ene investigation as well as many others. The purpose of the course is to provide experiences that help young people, ages 14 – 21, to mature and prepare them to become responsible and caring adults.

Off= icers Miller, Rodriguez, and Paolucci would instruct an initial class of approximately ten. Start-up c= osts will total roughly five thousand dollars and will come out of the Police Authority budget, although will be reflected in FY09’s contract amount for Crestview Hills.

MAYOR’S REPOR= T

Ø        Eggs and Issues feature the 2008 Economic Forecast for Northern Kentucky on Tuesday January 15 at the MET center located near Mineola Pike and I-275 starting at 7:15 AM.

Ø        Frank and Pat Sommerkamp celebrate their = 55^th anniversary this evening.

CITY ADMINISTRATOR’S= REPORT

Ø        Noted that the recent computer and mercury recycling program, offered through the Northern Kentucky Solid Waste Manage= ment group, netted over 1,500 lbs. of mercury and computer equipment.

OLD BUSINESS

= A.      =       Second Reading = of Ordinance 2007-12-1(formerly 2007-8-2)– Mary Ann Stewart explained the purpose of this ordinance is to rewrite chapter 110 of the Crestview Hills Code of Ordinances to include uniform rates, formulas, = and taxing structures to other Kenton County cities, but maintain the annual So= cial Security cap for collection of payroll taxes, and additional wording for Ke= nton County Fiscal Court to collect business licenses and taxes on behalf of the City. Mr. Kramer suggested cl= earer language for section 4, items 2(a) and 4(a).   Ayes carried.

The year 2007 turned out to be an excellent year for the City of Crestview Hills. The following events occurred duri= ng my tenure as Mayor for the previous year:

ECONOMIC DEVELOPMENT

n      =             &nb= sp; Colum= bia Sussex Corporation completed their eight-story, 100,000 square foot headquarters in the Thoma= s More Research Park.

n      =             &nb= sp; Tri-S= tate Gastro completed their new medical building on Centre View Blvd.=

n      =             &nb= sp; Ninet= y six apartments are in the process of being converted to condominiums by Schilli= ng Properties, with additional apartments to be converted over the next few ye= ars.

n      =             &nb= sp; Const= ruction for the Commonwealth Orthopedic Center began in 2007.

PUBLIC WORKS

n      =             &nb= sp; Thomas More Parkway was repaved in 2007.<= /p>
n      =             &nb= sp; Mall = Road was widened to improve traffic flow from Turkeyfoot Road to Town Center Blvd.

n      =             &nb= sp; Grant= s were received for widening Turk= eyfoot Road, adding a sidewalk on the east side of Dixie Highway, and landscaping a median on Di= xie Highway.

n      =             &nb= sp; Light= s were installed on Centre View Blvd.

n      =             &nb= sp; Curb = and gutters were installed on = Summit Drive, from Dixie Highway to Dixie Lane, as well as the repaving= of Summit Drive.

RECREATION

n      =             &nb= sp; The a= nnual City Picnic & Golf Outing at Summit Hills Country Club was another huge success.

n      =             &nb= sp; The <= st1:City w:st=3D"on">Cincinnati Reds and Florence Freedom baseball games were well attended.

n      =             &nb= sp; Over = 225 residents participated in our Tree Lighting Ceremony in December.

n      =             &nb= sp; A his= torical day trip to Henry County provided a f= un day for over 40 of our residents.

PUBLIC SAFETY

n      =             &nb= sp; The L= akeside Park/Crestview Hills Police Authority received re-accreditation in 2007.

n      =             &nb= sp; A new position of “Captain” was approved in 2007 and four officers received promotions.

n      =             &nb= sp; The C= ity signed an Interlocal Agreement with the City of Erlan= ger to provide dispatch services for fire, EMS, and police services to begin in 2008.

n          &= nbsp;          AD= MINISTRATION

n      =             &nb= sp; The C= ity once again received an award for “Excellence in Financial Reporting”= for the 10^th straight year from the Government Finance Officers Association (GFOA).

n      =             &nb= sp; The Meeting/Training Room in our new City Building provided a training facility= for organizations such as the Women’s Crises Center, Sexual Assault Nurses Training (SANE), The FBI, Ohio-Kentucky-Indians (OKI) Council of Government= s, and meetings of the Mayors, Clerks, and City Administrators of Northern Kentucky.

n          &= nbsp;          On a = personal note, I am proud to have fought having the Kenton County Jail and Detention Center from locating in our city and the rerouting of trucks from I-75 to I-275, which runs through our city and would result in many more traffic accidents and air pollution.

n          &= nbsp;          I was= also named to sit on the Board of the Kentucky League of Cities (KLC) in 2007 an= d I received the “Intergovernmental Unity of Effort” Award from Northern Kentucky Area Development District, which is their top honor each year.

n          &= nbsp;          And f= inally, I would like to thank all of the Council Members for working closely with me during the past year to again make Crestview Hills a wonderful place to work and to call home.

B.   &= nbsp; GOALS AND OBJECTIVES        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p;    &nb= sp;        =

In my tenth year as Mayor for the City of Crestview Hills, my goal once again = is to work closely with members of City Council and staff to continue to impro= ve our City in regards to continued economic development, recreation programs, infrastructure, fiscal responsibility, and safety for our residents and businesses.

2008 Goals & Objectives

1)      =       Conti= nue to work with developers to attract quality businesses to our Thomas More Research Park.

2)      =       Assis= t the Crestview Hills Town Center in achieving 100% occupancy= of upscale restaurants and retail establishments.

3)      =       Maint= ain low taxes while offering top quality services to our residents and businesses.<= o:p>

4)      =       Maint= ain communication with the Kentuc= ky Transportation Cabinet until the expansion of Turkeyfoot Road is completed.        =

5)      =       Encou= rage the Public Works Committee to maintain our excellent       infrastructure in respect to the condition of all streets within our community.

6)      =       Overs= ee the completion of sidewalks on the east side of Dixie Highway, from Dudley Road to the main entrance to= the Crestview Hills Town Center.<= /p>
7)      =       Offer= quality recreational programs for our residents.

8)      =       Conti= nue to offer our residents free trash and recycling collection and no insurance premium taxes.

9)      =       Upgra= de our City Web Page and offer the ability for residents to pay taxes online.=

10)      = Work = with SD #1 to allow final takeover of our storm sewer system.=

C.   &= nbsp; Committee Appointments for 2008 – as per attached. Motion made by Mr. Sommerkamp to a= ccept Mayor Meier’s recommendation for committee appointments, seconded by = Mr. Kramer. Ayes carried.

D.   &= nbsp; Appointment for Board of Adjustment vacancy - – created upon the retirement of= Bob McFalls, the Mayor will appoint Ron Gibbons, from the Lookout Farm subdivis= ion. <= /span>Motion made by = Mr. Kramer to accept Mayor Meier’s recommendation of Ron Gibbons to fill = the unexpired term of Bob McFalls on the Crestview Hills Board of Adjustment, seconded by Mr. Thiel. Ayes carried.

E.&n= bsp;            = ; Executive Sessi= on - to go into exec= utive session pursuit to KRS 61.810 section 1, item C, for discussion of delinque= nt property taxes. This was move= d to the end of the meeting after committee reports. =

C= OMMITTEE REPORTS

Public Works – Mr. Sommerkamp reported that:

Ø      =          The Kentucky Attorney General has ruled, in a letter received at the City Building on December 21, 2007, t= hat it is “unlawful for the City of = Crestview Hills t= o expend public funds to repair or maintain lakes in a privately owned subdivision, = or establish a “taxing district” for such purpose.” Therefore, the City will not be assisting the Old Crestview Hills, or any other, subdivision in the repair = or maintenance of the privately-owned “lakes.”
Ø      =          The walk/don’t walk crosswalk signal on CentreView Blvd.= at Thomas More Parkway has been relocated whereby it is believed that a lar= ge vehicle should not strike it.

Ø      =          Eaton Asphalt Paving Co. has compl= eted the resurfacing of Thomas = More Parkway. Some of the turn arrows and signage will be completed as soon as wea= ther permits.

Ø      =          Crestview Hills Mall Road has been repav= ed and widened to four lanes, once again thanking Central Bank for their contribution.

Ø      =          The City is negotiating with Carrabba’s restaurant to tap into their water line so that the median strip at the entrance and exit ramps to I-275 can be watered in the spring = and summer months.

Ø      =          The median strip located on Dixie Hwy. = in front of Lookout Farm has line of site issues and Scott Jones Landscaping (now Distinctive Designs) is looking at alternate solutions.

Ø      =          Rhine Valley Road at CentreView Blvd. is now a four-way stop.

Ø      =          Special attention should be given = to the Horsebranch Road water project to make sure the Northern Kentucky Water District restores the road properly and it is dually noted that the three residents living there = now have running “city” water and do not have to rely on their wells and/or cisterns.

Police Authority – Mr. Kramer noted:

v     Ch= ief Herbst recently attended additional field training.

v     Of= ficer-in-training Michael Paolucci was introduced to council members.

v     Ca= ptain Chris Schutte has been invited to attend the 233^rd session of th= e FBI National Academy starting Ma= rch 30, 2008.

v     Of= ficer Sam Goodman’s Army Reserve unit has been called to go to Afghanistan on February 4 and is expected to tour for at least one year.=

v     CE= RS has sent FY09 employer percentages, which have been slightly lowered.

v     A = female candidate has been interviewed and may begin the Academy upon passing a polygraph and drug screen.

v     Of= ficer Miguel Rodriguez assisted Covington PD with a murder case.

There was discussion about the new Erla= nger Police fees for coming to the aid of accident victims who are not Erlanger residents.

Fire/EMS – Dave Jansing reported on the a= nnual totals overall and as related specifically to Crestview Hills.

Economic Development and Zoning<= /u> – no meeting was held in Decembe= r, however, Mr. Kramer announced activity at the Gieske estate where two more houses are expected to be built, and Mayor Meier informed of Building Code violations on Whitehouse D= rive.

Recreation – Mrs. Bright reported on the following:

§      The next committee meeting will be Wednesday= January 16th.

Communications – Mayor Meier stated that an= other newsletter should be mailed after the end of January.

Building – Mr. Mo= ser reported on HVAC and lighting issues still present at the City Building and his ongoing negotiations with CDS Architects and subcontractors.

Mr. Sommerkamp requested that the Attorney General letter be made a part of the minutes.

Motion was made to go into executive sess= ion by Mr. Thiel, seconded by Mr. Sommerkamp with Mr. Kramer recusing himself.<= span style=3D'mso-spacerun:yes'> Ayes carried.

Motion was made by Mr. Sommerkamp, second= ed by Mr. Laird to come out of executive session. Ayes carried. 8:20PM

Council came out of executive se= ssion at 8:43 PM. Mr. Kramer was no= longer present.

Mary Ann Stewart advised the phr= asing of the motion as: to approve settlement and allow the Mayor to enter into agreement on behalf of the City of Crestview Hills with EG Properties, and Schilling Properties for payment of 2001 delinquent ad valorem real property taxes. Motion approved as sta= ted by Mr. Sommerkamp, seconded by Mr. Laird.

Motion to adjourn the council me= eting made at 8:45 PM by Mr. Laird, seconded by Mr. Thiel.
