REGULAR COUNCIL MEETING MINUTES =

THURSDAY, FEBRUARY 14, 2008

7:30 PM

CALL TO ORDER - With the Pledge of Allegiance= and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.=

ROLL CALL - Present were Messrs. David Kr= amer, Ralph Laird, and David Thiel as was Mrs. Colleen Collins Bright. Messrs. Frank Sommerkamp and Thomas= Moser were not in attendance.

APPROVAL OF AGENDA -

May= or Meier desired addition of item D under NEW BUSINESS – Mark Friedmann representing Hemmer Companies, wishes to present drawings for stage I and II approval for the construction of a small medical office building for Northe= rn Kentucky Dermatology.

App= roved as amended.

CITIZENS AND GUESTS

Jim Sparrow, Rankin, Rankin and Co., presented the audit findings of the fiscal year ending June 30, 2007. Specifically mentioned were pages:

v&nb= sp;    10 – Showing the Certificate of Achievement for Excellence in Financial Reporting for the prior fiscal year from the Government Finance Officers Association of the U.S. and Canada.= This is the City’s sixth consecutive award.

v&nb= sp;    12 – The independent auditor’s report expressing a clean opinion [= no material misrepresentations] on the financial statements. The Management’s Discussion = and Analysis, Letter of Transmittal, and other supplementary information is not audited, however, is reviewed.

v&nb= sp;    15 – Management’s Discussion and Analysis which informs the reader= of the various financial reports following and explains increases or decreases= in revenues or expenses.

v&nb= sp;    22 – 25 – Statement of Net Assets, Statement of Activities, and Balance Sheet, which are reflected in accrual, accrual, and modified accrual basis respectively. The City = at this time remains in good financial shape, although care should be exercise= d to avoid spending more than is received in future fiscal years.

v&nb= sp;    A special note was made for reminder to advertise for projects which require a formal bid and make sure to get affidavit.=

Motion was made by Mr. Laird, seconded by Mr. Kramer to accept the Comprehensive Annual Financial Report for fiscal year ending June 30, 2007. Ayes carried.

Also present were two Boy Scouts attending the meeting as a requirement for a ba= dge.

MAYOR’S REPOR= T

Ø        Mayor’s Group meeting Saturday Febr= uary 16 at Ft.= Mitchell City Building at 9AM.

Ø        Eggs and Issues features the New and Expanding Industry Report on Tuesday February 19 at Receptions in Erlanger = starting at 7:15 AM.

Ø        Tuesday February 19 is also City Night in= Frankfort from 5 = to 8PM. Meetings with legislator= s and discussion of legislative issues directly affecting cities are the main eve= nts.

Ø        The Northern Kentucky legislative caucus = will meet at the Erlanger City Building Saturday March 1 from 10AM to Noon.

Ø        Dixie Fix committee will meet Thursday ma= rch 6 at 9AM at the Northern Kentucky Planning Commission (NKAPC) on Royal Drive= .

Ø        Earlier in the month, Mayor Meier attende= d a meeting at the NKAPC to consider development of hillsides in Northern Kentucky. The University of Kentucky, Department of Landscape Architecture is a partner in the project.&= nbsp; Additional meetings will be held March 19 and April 21.

CITY ADMINISTRATOR’S= REPORT

Ø        NKAPC is offering HB 55 training Saturday February 21 from 8:15 AM to Noon for those requiring it.<= /p>
Ø        Kenton County is seeking a spokesperson from all cities having an Ethics Committee to att= end ethics training on February 25. Ky Webb will represent Crestview Hills.

OLD BUSINESS

NEW BUSINESS

A.   &= nbsp; First Reading= of Ordinance 2008-2-1 – Mayor Meier introduced Mike Schwartz from= the Northern Kentucky Area Planning Commission, who noted that until recently Crestview Hills was not considered in the flood plain. However, with improved technology,= Kenton County is undergoing re-mapping and a small area near Horsebranch Road and Orphanage Road has been declared a = flood plain area in this jurisdiction. In adopting the ordinance, the designation [of having a defined flood plain] c= an qualify affected areas for emergency funding and residents in defined areas= can now purchase flood plain insurance.

This ordinance is to adopt the Kenton County Planning & Zoning Commission’s recommendation regarding flood protection development controls for all political jurisdictions within Kenton County.

B.   &= nbsp; First Reading of Ordinance 2008-2-2 – to change the name of Crestview Hills Mall Road to Town Center Boulevard effective January 1, 2009 to reduce confusion for those needing an establishment in the Town Center or along the road leading to the Town Center. &nb= sp;                 &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p;    &nb= sp;        =

C.   &= nbsp; First Reading of Ordinance 2008-2-3 - A= MENDING 72.01 OF THE CRESTVIEW HILLS CODE = OF ORDINANCES SO AS TO ADDRESS THE PARKING OF SCHOOL BUSES AND SIMILAR VEHICLE= S IN EXCESS OF 30,000 POUNDS ON RESIDENTIAL STREETS.

Mary Ann Stewart noted that currently Crestview Hills parking ordinance addresses obstructional parking but is vague. The amendment is speci= fic toward the parking of school busses on residential streets

        &= nbsp;

D.   &= nbsp; Northern Kentucky Dermatology stage I and II<= /span> - Northern Kentucky Dermatology wishes to build a new medical building on= Chancellor Drive located in the RP-1 Zone. The= re would be two doctors and fourteen employees, 5,530 square feet, and located= on 1.28 acres, with only .99 acres being used. Zoning regulations require 35 park= ing spaces and plans call for 38 spaces.

Mr. Thiel, in the February Economic Development committee meeting, made the motion to recommend to Council that= the building be approved with the following added: (1) need a geo tech and grading permit from NKAPC, (2) remove first parking space on west= side because it only has a 22’ set back and a 30’ set back is requir= ed, (3) signage to be included wi= th a 25’ set back, and (4) additional landscaping is needed along the west side of the parking lot and around three sides of the proposed dumpster.

Mr. Kramer made the motion to accept Stag= e I and II for Northern Kentucky Dermatology Center subject to t= he conditions presented in the Economic Development Committee meeting. Motion seconded by Mr. Laird. Ayes carried.

C= OMMITTEE REPORTS

Public Works – Mr. Groth repor= ted that:

Ø      =          The committee will be doing its an= nual drive-through of the City in April and will submit projects for budget consideration.

Ø      =          Thomas More Parkway has signage on= the traffic signal wire for those turning either direction onto Turkeyfoot Road indicating proper l= ane usage until the weather is such that the markings can be successfully repai= nted onto the blacktop surface.

Police Authority – Mr. Laird and Mr. Kramer noted= :

v     Mr. Laird now chairs the Authority with Paul Markgraf from Lakeside Park City Council as second chair.

v     Th= e next meeting is Monday February 25 at 5:30PM.

Chief Herbst informed council members o= f an emergency action drill that will take place at Thomas More College in March. The scenario will be that of a sch= ool shooting. Chief also commended staff for their assistance and participation in relation to recent meetings= and events the Police have hosted in the City’s meeting room.<= /span>

Economic Development and Zoning<= /u> – covered under item D, New Busi= ness.

CHEER – Mr. Thiel stated that the committee is recommending that t= he City renew its contract with Bavarian for the final two years of the extend= ed contract, which runs from July 1, 2008 to June 30, 2010. The City now pays $174,160.08 year= ly for residential trash and recycling collection. The renewal rate will be $181,887.= 92 per year, or an increase of five percent. Mr. Thiel made the motion to accept the committee’s recommendation, seconded by Ms. Bright.&nb= sp; Ayes carried.

Recreation – Mrs. Bright reported on the following:

§      The next committee meeting will be Wednesday= February 20 at 11AM.

§      A newsletter just went out listing Reds games and the Easter party.

§      The Easter party will be Saturday March 15 at 11AM in the City Building meeting room. Goodie bags will be available for distribution to those in attendance as well as pictures with the Easter bunny. This is at no cost to = our residents.

Personnel – Meeting Wednesday April 9 to evaluate staff.

Telecommunications – Mayor Meier affirmed evaluation of the latest franchise agreement with the Telecommunications Board of Northern Kentucky.

Communications – Mayor Meier stated that in newsletter recently mailed was a brief summary of the latest business licen= se ordinance, which can be printed in full from our website.=

Building – Mr. Gr= oth reported on HVAC and lighting issues still present at the City Building and his ongoing negotiations with CDS Architects and subcontractors.
