REGULAR COUNCIL MEETING MINUTES =

THURSDAY, JULY 10, 2008

7:30 PM

CALL TO ORDER - With the Pledge of Allegiance= and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.=

ROLL CALL - Present were Messrs. Ralph La= ird, Frank Sommerkamp, Thomas Moser, David Kramer, and Dav= id Thiel as was Mrs. Colleen Collins Bright.

APPROVAL OF AGE= NDA -

May= or Meier desired the addition of item B under New Business - Discussion of the proposed = Kenton County smoking ban. Approved as amended.

No discussion or motions on the brief public hearing minutes for June 12, 2008 referencing municipal road aid.

MAYOR’S REPOR= T

Ø Eggs and Issues will be held July 15 at t= he Receptions Center in Erlanger commencing at 7= :15AM. The topic is the state of Northern Kentucky with Judges Executive from Boone, Kenton, and Campbell counties speaking.

CITY ADMINISTRATOR’S= REPORT

Ø Congratulated C.R. Wirthlin on the receip= t of the seventh consecutive Certificate= of Achievement for Excellence in Financial Reporting award from the Govern= ment Finance Officers Association of the U.S. and Canada.

Ø The Northern Kentucky Area Development District is holding their annual awards dinner Monday August 18 at Receptions Center in Erlanger at 6PM.

Ø The Kentucky League of Cities annual conference is October 16 to 18 in Louisville.

Ø A staff person from the Northern Kentucky Area Planning Commission could attend a future council meeting to field questions regarding the new model sign ordinance proposal.

OLD BUSINESS

NEW BUSINESS

A.<= span style=3D'mso-spacerun:yes'> Resolution 2008-7-1<= /b> –= Mayor Meier not= ed that at the requests of the representatives of local governments, the North= ern Kentucky Area Planning Commission drafted a “Model Sign OrdinanceR= 21; that would best meet the needs of local governments and fulfill the aesthetic desires of the community. A number of definitions in the old model ordinance were revised and/= or deleted; a more comprehensive scheme was drafted to better regulate signage [includi= ng billboards] throughout Northern Kentucky; temporary signage was addressed with more depth, as was signs allowed witho= ut a permit.

        &= nbsp;   At its meeting of Thursday, June 5, 2008, the Kenton County Planning Commission elected to table the Model Sign ordinance.

The City of Cre= stview Hills requests that the Kenton County Planning commission consider adopting= the Model Sign Ordinance as submitted in order to provide a quality, reasonable, and constitutionally-sound document that legally protects the local governm= ents and the authority granted to it while at the same time also meets the aesth= etic desires of the community.

General discuss= ion ensured regarding Crestview Hills current ordina= nces and what would change, if anything, once the new model ordinance is adopted. Residents and busine= sses could still have the option of going before the Crestview Hills Board of Adjustment if a variance from the ordinances is required or desired.

Motion to accept the resolution made by M= r. Sommerkamp , seconded by Mr.Moser. Ayes carried.

B.&n= bsp;             Discussion of p= roposed Kenton County smoking ban =

The Mayor updated council on Boone, Kenton and Campbell counties considering an ordinance that would ban smoking in certain places.
The proposal is in the very early stages, but a coalition of health awarene= ss groups called Northern Kentucky Action has been researching the issue and h= opes to get a first reading in mid-July.
To enact an ordinance, each county would all have to agree on the same plan.

Mayor Meier presented a table which lists restaurants in Crestview Hills and whether each has a smoking and non-smoki= ng section. Of 18 restaurants, 7= allow smoking, 11 do not.

Council members stated an opinion on the prospect of Kenton County enacting a s= moking ban ordinance:

Mr. Thiel confirmed that City of Florence unanimou= sly avowed no smoking ban thus leaving municipalities the option for more strin= gent regulations regarding smoking within each community.

Mr. Moser was against a smoking ban noting that government should not over regulate businesses.

Mr. Kramer likened smoking and non-smoking sections in a restaurant to a “peeing and non-peeing” section o= f a pool and was firmly for a ban.

Mr. Laird thought it interesting the 7 restaurants that do allow smoking.

Mr. Sommerkamp likened a smoking ban to “sugar police and wondering if monitoring co= uld occur between 8 and 9 AM each morning to check the sugar content of cereal.”

C= OMMITTEE REPORTS

Public Works – Mr. Sommerkamp reported that:

Ø      =          The City has been awarded a grant = to construct a sidewalk along the east side of Dixie Highway from Dudley Road to the north entrance t= o the Town Center. Construction time tables are uncer= tain at this time as the project is being funded through the Kentucky Transporta= tion Cabinet with CMAQ (congestion mitigation air quality) grants. Crestview Hills will be responsibl= e ultimately for the design and construction of the sidewalk.

Ø      =          It was discussed also that KTC will first bid engineering and design services for the I-275 westbound ramp additional left turn lane project (from northbound Tur= keyfoot Road) and the Dixie Highway/Dudley Road project, then, once designs have be= en submitted and approved from the winning bidder, the construction will then = be bid on those projects. <= /o:p>

Ø      =          Part of Woodspoint Drive paving will be removed and replaced with concrete paving. The work should begin soon and be completed before mid-October.

Ø      =          The resurfacing of Legends Way and Right Fork Road was completed by Ju= ne 30 by Paul Michels and Sons of Michels Construction.

Ø      =          Lookout Farm Drive extension will be repair= ed in FY 09, with recommended repairs taking place before the end of this calendar year.

Ø      =          Druid Lane, Warwick Court, and Rossmoyne Drive from Winding Way to Druid Lane will be resurfaced in August.

Ø      =          Curb corners at CentreView Blvd. and Thomas More Pkwy. have been repaired again.

Ø      =          The plantings throughout the City = look great with the amount of spring rains they have received. Discussions are ongoing to try to = co-op with a private business to get water to the planting at Dixie Hwy and I-275 ramps.

Police Authority – Mr. Kramer reported:

v     The expenditures for FY 09 were passed by the Board with Crestview Hills paying= 68% of the total and Lakeside= Park paying 32% of = the 1.348M budgeted figures.

Fire/EMS – Dave Jans= ing, Ft. Mitchell Fire Dept., recalle= d the events of a house fire on Trevino Ridge recently.

Economic Development and Zoning<= /u> – Mr. Kramer noted that a meetin= g was not held in July. The sign ordinance will be revisited at the next KCMPZC meeting. Servatii will open toward the end of July where Weinerhaus us= ed to be and next to Dewey’s Pizza in the outlot closest to Dixie High School.

Recreation – Mrs. Bright reported on the following:

§      The next committee meeting will be Wednesday= July 23 at 11AM.

§      Committee member Sherri Higginbotham is leav= ing the committee since she is moving and Erin Timmerding<= /span> has asked to join the committee to research programs for young children.

§      Water color classes with Terry Freytag began Monday June 23 and will run until August 4.

§      Tickets for the Reds game on July 19 have be= en sold out. Participants will e= njoy the game from the party deck.

§      Florence Freedom game July 12. Residents may purchase tickets for= the game, which includes a buffet meal in the Eagle’s Nest area, for ten dollars during regular office hours.

§      The committee is gearing up for the annual picnic and golf outing Tuesday August 5 at Summit Hills Country Club. Sign ups are being accepted at this time. More detailed informati= on and a sign up form are available in the recently mailed newsletter.

§      October 9 is the date for the fall bus trip scheduled to Woodford County for lunch, shopping, and a tour of the distillery.&nb= sp; Reservations with payment are being taken at this time.

Communications – A newsletter was just mail= ed at the beginning of the month with information and sign-up form for the golf outing and picnic, and other recreational events.

Building – Mayor Meier stated that bids are being accepted for a lobby window project and a software package will be purchased which is supposed to better regulate the temperatures in the building.
