MINUTES - REGULAR COUNCIL MEETING
May 11, 2000
CALL TO ORDER - With the Pledge of Allegiance and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.
ROLL CALL - Present were Messrs. Ralph Laird, David Kramer, Harold Ries, Joe Maloney, Frank Sommerkamp and Mrs. Robin Huller.
APPROVAL OF AGENDA- Mayor Meier wished to add under New Business Item D) Ordinance 2000-5-3 which pertains to the collection of annual license fees and clarification of section 110.04 of the Crestview Hills Code of Ordinances. A deletion of comments under Citizens and Guests was also recommended. Approved as amended. Ayes carried.

APPROVAL OF MINUTES - Mr. Sommerkamp observed that in last month’s minutes under the Public Works report, last bullet, should have stated that the storm water detention facilities will be handled by the state, not the City. Accepted as amended. Ayes carried.

Mr. Celarek reported on the following:
A. Zoning
Mr. Celarek introduced Mike Gallenstein, Paul Gallenstein, and Gene Webber from the Gallenstein Co. and reported that the Economic Development Committee met on Tuesday, May 9th at 7PM at the City Building to discuss the Gallenstein project on Mall Road. There are two, two story office buildings with 49,856 total square feet and 220 parking spaces. The plan uses the 35-foot variance granted by the Board of Adjustments for parking in the front yard area along the Mall Rd. frontage. There are three stipulations for the front yard variance on Mall Rd. They are: 1) the “accessory use” restaurant within the development shall not exceed seating capacity for 70 people seated at tables, 2) the hours of operation of a restaurant shall not exceed 7PM on any given day, and 3) there shall be no alcohol served in the buildings. This action by the Board of Adjustments will be recorded as a “land use restriction” in the near future.
Mr. Webber noted the dumpster at the southeast corner of the site, 150 feet from the nearest residential property to the south. The dumpster will be covered with landscaping and masonry. The time of solid waste pickup was a concern of council. Mr. Gallenstein commented that a letter was being drafted to send to BFI to request pickup occur only between the hours of 9AM to 7PM.
A sanitary sewer runs along the rear of both buildings and empties into a small creek. Mr. Berling, engineer for the Gallenstein project and the City, felt that the 48-inch storm pipes being used would be able to sustain a storm of six inches of rain per hour. Discussion ensued over the perceived effect of that amount of output on the small creek into which the storm pipes empty. Messrs. Webber and Gallenstein wished to note that NKAPC approved the storm water calculations for this project.
The lighting plan shows six 400-watt metal halide lights mounted on 25-foot high poles. Each light is shaded to show a drop-lighting pattern concentrated in the center of each parking lot to focus the light downward to avoid trespassance onto residential property. It was questioned as to whether the lumination from the lights already installed on Mall Rd. were taken into consideration. They were not, however the developer and engineer declared that the effect, if any, would be minimal.
The screening plan consists of 50 trees at strategic points to shield residential areas further from overhead or automobile lighting. It is recommended that six more trees be added to the plan as well as shrubbery along the eastern and western sides of the parking lots.
Discussion took place regarding the sidewalk on Mall Rd. Mr. Gallenstein agreed to replace portions of the sidewalk that should become damaged in the construction process.
Mr. Celarek inquired about possible traffic tie-ups on Mall Rd. The concern is that the entrance to Coldwell Banker/West Shell/ Friday’s and the Gallenstein office are directly opposite each other and near the left turn lane from Mall Rd. to Turkeyfoot Rd. Mr. Berling stated that there would be no problems once Mall Rd. is re-striped.
Mr. Kramer noted that the Economic Development Committee passed the May 5, 2000 site plan contingent upon the compliance by the Gallenstein Co. of staff and NKAPC recommendations, which are:

NEW BUSINESS
A. Ordinance 2000-5-1
Mr. Laird noted that this is an ordinance adopting the City of Crestview Hills, Kentucky annual budget for the fiscal year 7/1/2000 – 6/30/2001. The Finance Committee awaits confirming figures from the Police Authority and Public Works. This is considered first reading.
B. Ordinance 2000-5-2
Mayor Meier informed Council members that the City is currently the only fifth class city or higher not in CERS. The system, which is maintained by the State, requires a contribution by the City of 7.28% and by the employee of 5%. Currently the City contributes 9% of gross salary to a SEP-IRA for employees. Once the City joins CERS, it cannot withdraw and every new employee would have to join. Discussion took place on the benefits offered through CERS. Three Crestview Hills employees submitted written confirmation that they wish to be in CERS. The personnel committee reviewed the policy and recommended the City of Crestview Hills join CERS. This is considered first reading.
Mr. Laird wished to go on record as opposing CERS.
Mayor Meier introduced Ordinance 2000-5-3, which would clarify section 110.04 of the Crestview Hills Code of Ordinance to state that the withholding of local taxes shall apply to employees, appointed, and elected officials of the City of Crestview Hills. This is considered first reading.
COMMITTEE REPORTS
Public Works - Mr. Sommerkamp commented that the Public Works committee toured the City on April 24 th to note areas that will require attention in the upcoming year. Scott Jones Landscaping, Inc. won the bid for the plantings that will be installed on the southeastern corner of Turkeyfoot Rd. and College Park Dr. and Dixie Hwy. at Winding Way. Other projects at this time include:
Appreciation was expressed for the assistance of Rep. Jon Draud in acquiring state funding for two projects next fiscal year.
Finance - Mr. Laird requested that committees begin working on budgets for FY01. First reading will take place next month.
Police Authority – Mrs. Huller reported that Officers Shutte and Leberecht are undergoing bicycle training. The accreditation process continues.
Safety – Mrs. Huller reported that the Neighborhood Watch groups from Old Crestview Hills and College Park plan to meet at the City Building on June 1, 2000 at 7:30 PM. Discussion ensued regarding the overnight parking ordinance. Mr. Maloney expressed concern that residents might be having problems with parking for guests. Mrs. Huller said that the committee and the Police Authority would look into the matter and make a recommendation at next month’s meeting. Mayor Meier interjected that Kenton County has taken responsibility for maintenance and operation of the severe warning sirens.
Economic Development – Mr. Kramer noted that the Gallenstein Development was the main topic of discussion. Mr. Sommerkamp expressed uneasiness about the Ashley Development on Legends Way. The address was approved through KC/MP/ZC to be 500 Thomas More Pkwy., even though there is no curb cut on Thomas More Pkwy. Mr. Sommerkamp wished staff to appeal the decision by KC.MP/ZC. Mr. Kramer stated that the committee is possibly looking into an ordinance that would limit the number of hours in which commercial trash may be collected.
Recreation - Mr. Celarek, Mrs. Huller, and Mayor Meier collaborated to note that the next meeting of the Long Range Recreation Committee will culminate in the separation of the focus groups. That meeting will be held May 17 th at 7PM at the Holbrook Student Center..
Personnel - Mayor Meier mentioned to council that the staff is undergoing evaluations at this time and another meeting of the committee is forthcoming.
