MINUTES - REGULAR COUNCIL MEETING

DECEMBER 10, 1998

CALL TO ORDER - The meeting was called to order at 7:30 PM by Mayor Harold A. Ries with the Pledge of Allegiance and a silent prayer.

ROLL CALL - Present were Messrs. Paul Meier , Ralph Laird , John Drummey, Joe Maloney, Frank Sommerkamp and Mrs. Beverly Draud.

APPROVAL OF AGENDA - Mr. Meier wished to add item D) to new business to discuss a new KC&MP&ZC representative. Also, after New Business and Committee reports have been given to go into Executive Session to discuss financial matters. Approved as amended

APPROVAL OF MINUTES - Minutes from the regular meeting of November 12th were accepted as written.

CITY ADMINISTRATOR’S REPORT

Mr. Celarek reported on the following:

  1. There will be a retirement reception at Four Seasons Sports Country Club for Mayor Ries, Beverly Draud and John Drummey to be held December 17th from 4 to 6:30 PM.
  2. There has been modest progress on the I-275 lighting and noise issues. Meetings have been held with Jim Shay and Joe Kearnes of the Kentucky Dept. of Transportation. There were four bulbs removed from the fixtures directly affecting residential areas. Another letter will be sent to the Secretary of the Dept. of Transportation about noise readings taken on I-275.
  3. Christmas tree curbside recycling will take place on Tuesday, January 5th and Friday, January 8th. No garbage pickup will take place on Christmas or New Year’s Day, nor is there a rescheduled pickup for those days.
  4. The plans for Dixie Highway sidewalk were delivered to the City Building this afternoon so hopefully construction will begin in the spring.
  5. A special showing of "Prince of Egypt", sponsored by Crestview Hills, will be shown at the Florence Showcase Cinemas on Saturday, December 19th at 9AM. Tickets may be purchased at the City Building for two dollars.

OLD BUSINESS

A. Economic Development

Mr. Celarek read a letter from Marriott NGH withdrawing their proposal for an assisted living facility. Reasons for withdrawl were stated as current competition, market condition and the site cost. The conditional use permit goes with the lot and on December 1st, the Board of Adjustments voted to rescind the conditional use permit for that lot. In progress are two other assisted and independent living facilities, Grand Court Lifestyles and The Waterford, submitting stage I plans.

The Board of Adjustment also reviewed the assisted and independent living facility saturation studies conducted by the Danter Co. for Ashley Development and Project Market Decisions for Crestview Hills. The studies showed 111 independent living facilities with no great need for assisted living facilities. However, the Board of Adjustment believes when Marriott NGH withdrew, the study results changed enough so the Northern Kentucky market could bear the number of assisted and independent living facilities being constructed in Crestview Hills.

NEW BUSINESS

  1. Economic Development

Mr. Celarek stated Grand Court Lifestyles is an independent and assisted living facility that will be located on a 5.6 acre lot in the Northwest corner of Legends Way and Thomas More Pkwy. The Board of Adjustments approved the conditional use permit on November 17th on the condition the building be all brick and have a standing seam metal roof.

Tom Bridenstein from Deters, Benzinger & Level noted Grand Court is a publicly traded company on the NASDAQ that owns and manages over 50 communities in 12 states.

Bill Krutzjans from Ashley Development commented the building will be three stories and L - shaped with a common area containing beauty shops, dining areas, libraries, card rooms, etc. There will be 92 parking spaces in a parking lot that is accessed via a driveway from Legends Way. A sidewalk will be constructed to run from the building to Legends Way. Rooms within the building will have cooktops, not full ranges, as originally thought. Firewalls will be installed according to building code and the building will have sprinklers installed throughout.

Mr. Meier made the motion to accept this as a minor change to the Stage I development plan of the Research Park under the conditions that: 1) all setbacks are met, 2) the extra driveway be removed, 3) the building be all brick, 4) the roof be standing metal seam, 5) a sidewalk be constructed from the facility to Thomas More Parkway, 6) all other regulatory items be met such as drainage, 7) all new utilities to be underground, and 8) all drives be 24 feet. Motion seconded by Mr. Sommerkamp. Ayes carried.

B Economic Development

The Waterford is an independent living project submitting stage I approval at the corner of Rhine Valley Lane and Centreview Blvd. on a 6.8 acre lot. The two-story building will house 120 units and the parking lot will contain 90 parking spaces. On December 1st, the Board of Adjustments granted the conditional use permit providing the building be all brick, have a standing seam metal roof and a sidewalk be constructed from the facility to Centreview Blvd. and Rhine Valley Lane.

Mr. Don Avery gave some history on Capital Senior Living and stated it is traded on the NYSE.

Mr. Meier noted the setback requirements for this zone then made the motion to approve this as a minor change to the stage I development plan for the Research Park with the conditions set forth in the recommendations by the NKAPC and the Economic Development Committee. Motion seconded by Mr. Sommerkamp. Ayes carried.

  1. Economic Development

Bill Krutzjans from Ashley Development described a two-story, 15, 360 sq. ft. general office building to be located on lot 7 at the corner of Day Care Dr. and Legends Way. The front of the building will face Thomas More Parkway. The site is one acre and contains 66 parking spaces.

There are two zoning issues regarding this development as follows:

    1. The building is set back only 30 feet from the south property line. If this is the rear yard, the code requirement is for 40 feet.
    2. Day Care Drive is not a dedicated public street. However, it is a paved roadway with a street name sign as well as city traffic control signs. It’s definition as a street or not creates several zoning issues, they are:

If Day Care Drive is a street:

    1. No parking or building is permitted within 30 feet of the property line. This causes the loss of 14 spaces which would make them out of compliance with the zoning code requirement.
    2. Lot 7 becomes a corner lot and the code permits a rear yard to be located to the east side of the building making the building conforming.
    3. Access to the parking lot is permitted.

If Day Care Drive is not a street:

    1. Building is permitted within 30 feet of the west property line. Property line is the center line of the street. Thus, setback is 20 feet from the curb.
    2. Parking spaces are permitted within 10 feet of the west property line. Thus, parking could be located at or near the curb.
    3. Access to off-street parking is prohibited.
    4. The building would not comply with the rear yard setback requirement of 40 feet.

Much discussion ensued. Mr. Sommerkamp made the motion that based upon the recommendation of the Economic Development, to approve the stage I plan for the Ashley Building subject to conformance with zoning requirements and/or a successful appeal, seconded by Mrs. Draud. Mr. Meier asked to Mayor if he would call for a vote for clarification purposes.

  1. KC&MP&ZC

Mr. Meier informed council that Richard Lonergan is resigning as the Crestview Hills representative to the KC&MP&ZC effective December 31, 1998. It is recommended by Mr. Meier to appoint Joe Price to fill the unexpired term of Mr. Lonergan, seconded by Mr. Drummey.

COMMITTEE REPORTS

Public Works - Mrs. Draud thanked everyone involved who has and does work to continue to make Crestview Hills a unique place to live

Police Authority - Mr. Meier stated that some salary adjustments were made at the last meeting. There will be a Long Range Police Study meeting with some of the officers on December 2nd to discuss technology issues that will hopefully improve the safety of the citizens and officers.

Recreation - Mr. Meier commented that Cincinnati Cyclones tickets for January 23rd, which is NASCAR night, are being sold at the City Building during normal business hours. There is a special showing of "Prince of Egypt" on Saturday, December 19th at the Florence Showcase Cinemas. Tickets are two dollars each for the special showing and may also be purchased at the City Building.

Safety - Mr. Meier stated that he would like to remain the chair of the Long Range Police Study for as long as it continues. The next meeting will be Wednesday, January 14th at 4PM.

After general conversation, motion to go into executive session was made by Mrs. Draud, seconded by Mr. Sommerkamp. Motion to come out of executive session was made by Mr. Drummey, seconded by Mr. Sommerkamp. Motion to adjourn made by Mr. Laird, seconded by Mr. Draud at 8:45 PM.
