REGULAR COUNCIL MEETING MINUTES
THURSDAY, JULY 13, 2006
7:30 PM
CALL TO ORDER - With the Pledge of Allegiance and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.
ROLL CALL - Present were Messrs. Frank Sommerkamp, David Kramer, Ralph Laird, Tony Maschinot, and Thomas Moser. David Thiel did not attend.

CITIZENS AND GUESTS
None.
a) Kenton County Mayor’s Group monthly meeting is being held Saturday July 15 at the Erlanger City Building at 9AM.
b) The three County Judge Executives will speak on the State of Northern Kentucky during Tuesday July 18th Eggs and Issues at Receptions in Erlanger.
c) The Northern Kentucky Area Development District’s annual meeting will be held Monday August 21 at Receptions in Erlanger.
d) The Northern Kentucky Chamber of Commerce’s annual dinner is Thursday September 21 at the Northern Kentucky Convention Center.
e) The Kentucky League of Cities convention will be held in Lexington from October 4 – 7. Reservations need to be made by September 15.

OLD BUSINESS
A. Ordinance 2006-6-1 – second reading of an ordinance to regulate sexually oriented businesses. The purpose of the ordinance is to limit where this type of business could locate within the City, since it was designated by Garry Edmonson, Kenton County Attorney, as a potential location within the county. The U.S. Supreme Court has set precedence saying that cities cannot regulate a sexually oriented business so that they cannot conduct business, nor can they be banned, as these actions are considered violations of the First Amendment.
Mayor Meier recounted the letter that was sent to all residences and businesses in the City explaining what actions were being taken on the subject and why.
After general discussion, Mr. Sommerkamp made the motion for passage of the ordinance after reading the header, seconded by Mr. Laird. Ayes carried.
NEW BUSINESS
A. Declaration of Surplus Property – Mayor Meier noted to council that since the administrative offices would be moving into the new building on, or about, July 27, that most of the furniture and some equipment will be declared surplus and given to eleemosynary or governmental institutions. The list is as follows:

Motion to accept the Mayor’s recommendation of surplus property and its disposal was made by Mr. Sommerkamp, seconded by Mr. Moser. Ayes carried.
COMMITTEE REPORTS
Public Works – Mr. Sommerkamp reported on the following:
Ø As part of the new construction at the Dixie Heights High School, the school will be constructing a curb and gutter along the south side of Summit Drive from Dixie Highway to Dixie Lane at the old Caywood School site.
Ø The City submitted a preliminary plan to the Kentucky Transportation Cabinet for widening Turkeyfoot Road to allow for an enlarged left turn lane from northbound Turkeyfoot Road onto Crestview Hills Mall Road. The new lane should hold approximately seventeen cars.
Ø The planted median strip on Turkeyfoot Road will receive an automatic watering system next month.
Ø The large median strip on Dixie Highway between Winding Way and I-275 will be excavated, irrigated, and planted this fall. Construction will begin in August.
Ø The City is studying Crestview Hills Mall Road to develop possible solutions to traffic problems. Discussion ensued on suggestions made in committee regarding redevelopment of Mall Road to reflect one in lane, one left only lane, one straight/left lane, and one right only lane. More information to follow.
Police Authority – Mr. Laird stated that Lakeside Park City Council has yet to pass a budget for FY07, therefore the budget for the Police Authority is still tentative. Mr. Kramer informed council that two candidates, a male and a female, are enrolled at the academy, doing well, and should graduate in late October. Mr. Sommerkamp suggested to Col. Herbst that the Police only give a warning when a car is parked on the street overnight as some of his neighbors have complained about receiving the five dollar ticket.
Fire – Mr. Maschinot expressed concern over the omission of Ft. Mitchell Fire Department’s smoke detector give away in the last newsletter. Mr. Groth assured that notice was made in both the Enquirer and Kentucky Post, however staff will note it in the next newsletter.
Economic Development – Mr. Kramer informed council on the committee’s review of:
Ø Scott Schilling of Schilling Properties stated that his company was in the process of purchasing eight buildings at Grandview Summit. The goal is to change these units from apartments to condominiums and give current tenants the option to buy or stay until the end of their current lease.
Ø A proposal by Gallenstein Developers to build the second office building which would locate directly across from the City Building and house a bank branch on the first floor with a drive-through ATM. The suggestion was recommended to donate the small strip of land across the street that currently belongs to the City to the project when the time is proper. No formal action was taken.
Ø Mer Grayson with the Central Bank of Northern Kentucky declared a desire to locate this family-owned bank at the southwest corner of Turkeyfoot and Mall Roads. The building would be approximately 2500 square feet and proposes curb cuts on both Turkeyfoot and Mall Roads.
Recreation –Mr. Maschinot recounted Father’s Day at Kings Island where about 100 people attended, water color classes, which have just begun with 18 participants, Saturday July 22 versus the Milwaukee Brewers, , an evening at the Florence Freedom on Tuesday July 18 and August 8 for the City picnic at Summit Hills CC as recreational activities in the works at this time.
Telecommunications – The Northern Kentucky Telecommunications Board is working with the City on new equipment for a room in the new building and the labor will be provided at no cost to install.
Building – The project is about a week behind at this point and preliminary scheduling has indicated a move-in date of July 27 with a VIP dedication Friday August 25 and the general grand opening Saturday August 26.
After general discussion, motion to adjourn was made by Mr. Laird, seconded by Mr. Kramer at 8:21 PM.
