REGULAR COUNCIL MEETING MINUTES

THURSDAY, JUNE 8, 2006

7:30 PM

 

CALL TO ORDER - With the Pledge of Allegiance and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.

ROLL CALL - Present were Messrs. Frank Sommerkamp, David Kramer, Ralph Laird, David Thiel, and Thomas Moser.  Tony Maschinot did not attend.

APPROVAL OF AGENDA Agenda approved as submitted.

APPROVAL OF MINUTES – Regular meeting minutes of May 11, 2006.     Approved as submitted.

MAYOR’S REPORT

None.

City Administrator’s Report

1)     Thursday June 29, the Kentucky League of Cities is sponsoring a City Summit teleconference which will focus on health care and retirement system cost escalation and the results of the tax modernization task force.  The host site is Versailles, KY, with telelink sites in Hazard and Paducah.

2)     Also on Thursday June 29, the Northern Kentucky Area Planning Commission is holding their annual summer meeting at the Drawbridge Inn.  Dinner begins at 7PM with the topic being The Brent Spence Bridge:  How close are we to relief and the congestion that will precede it?

3)     Monday August 21 at 6PM is when the Northern Kentucky Area Development District shall hold its 35th annual dinner at Receptions in Erlanger.

 

OLD BUSINESS

 

A.             Ordinance 2006-5-1 – second reading of an ordinance to adopt the City of Crestview Hills annual budget for the fiscal year 7/1/06 – 6/30/07.       Motion to accept as presented made by Mr. Laird, seconded by Mr. Kramer.  After clarification of some line items by Mr. Sommerkamp, ayes carried.

NEW BUSINESS

 

A.             Agreement between Crestview Hills, Edgewood, and Kenton County School BoardMary Ann Stewart, City Attorney, noted that the City of Crestview Hills and the Kenton County Board of Education have entered into a storm sewer agreement for the replacement of an existing storm sewer outfall system from the creek on the east side of Dixie Highway near Dudley Road, up Summit Drive and through the Dixie Heights high school campus (actually located in Edgewood) to the creek behind the houses on the southwest side of Summit Drive and there is an opportunity to secure partial funding for the construction costs through the Sanitation District No. 1’s stormwater cost sharing program but the program requires local governments to be co-applicants for the funding.  Mr. Moser made a motion to permit the Mayor to enter into the funding agreement with the City of Edgewood and the Kenton County School Board.  Motion was seconded by Mr. Thiel.  Ayes carried with Mr. Sommerkamp voting nay.

B.             Ordinance 2006-6-1 –first reading of an ordinance to regulate sexually oriented businesses.  The purpose of the ordinance is to limit where this type of business could locate within the City, since it was designated by Garry Edmonson, Kenton County Attorney, as a potential location within the county.  Mr. Kramer noted that the Economic Development Committee has been reviewing this issue for some time as a regional approach.  The committee recommends adopting an ordinance which limits locations; otherwise, sexually oriented businesses could potentially locate in several areas within the City. 

Mary Ann Stewart informed council that a media/bookstore, not an entertainment facility, would be about all that could locate near the town center.  The courts have set precedence saying that cities cannot regulate a sexually oriented business so that they cannot conduct business.

Mr. Sommerkamp suggested sending a letter from the Mayor to Crestview Hills’ residents explaining the situation and why the City would consider passing an ordinance such as this. 

 

COMMITTEE REPORTS

Public WorksMr. Sommerkamp reported on the following:

Ø               As part of the new construction at the Dixie Heights High School, the school will be constructing curb and gutter along the south side of Summit Drive from Dixie Highway to Dixie Lane at the old Caywood School site.

Ø               The City has resurfaced University Circle, University Drive, West College Park Drive, part of CentreView Blvd. and part of Winding Way.  Eaton Asphalt Paving was the contractor.

Ø               The City submitted a preliminary plan to the Kentucky Transportation Cabinet to widen Turkeyfoot Road to allow for a new left turn lane from northbound Turkeyfoot Road in Crestview Hills Mall Road.  The proposal is for a full stacking lane, which according to preliminary estimates could cost around $500,000.  Traffic concerns will continue to grow as the expansion of Turkeyfoot Road south of Dudley Road nears and the possible addition to our RP-1 area of an 8-story corporate headquarters. 

A motion was made by Mr. Sommerkamp for the City of Crestview Hills to contribute 10% of the total project cost, or not to exceed $50,000, if Kentucky Transportation Cabinet decides to undertake the project in this fiscal year.  Motion seconded by Mr. Kramer.  Ayes carried. 

Ø               The cost to reconstruct the median in front of the Town Center on Dixie Highway and to install an irrigation system in the median strip landscaping project on Turkeyfoot Road in near TGI Fridays will cost $32,000.  Scott Jones Landscaping will be doing the project and stated that the project should be completed before June 30.  If the project is not completed, the full cost will be accrued in this fiscal year and encumbered for FY07.

Ø               Hemmer Company removed the dumpster that was at the very end of Chancellor Blvd. and has seeded the area. 

 

Police Authority – Mr. Kramer informed council that two candidates, a male and a female, are enrolled at the academy and should graduate in late October.

 

Economic Development – Mr. Kramer informed council on the committee’s review of:

Ø            A proposal by Hemmer Company on the construction of an 8-story headquarters for Columbia Sussex, who recently purchased Aztar Casino in Evansville, IN and The Tropicana in Las Vegas, NV.  The Board of Adjustment voted June 5th to grant a variance for a building sign.  The Company has stated that they are committed to the project if the variance was granted.  Council should see stage I and II plans in the next couple of months.

Ø            Greg Noll, Town Center Manager, has suggested having a “Taste of Crestview Hills” event on a Saturday in early October.  Several new businesses have opened in recent weeks, noting: Hoggys, Auntie Anne’s Pretzels, Omaha Steaks, Spa 413, and very soon, Eddie Bauer.    

RecreationMr. Groth recounted the obtaining of the Party Deck for the Cincinnati Reds game on Saturday June 17 versus the Chicago White Sox, and Saturday July 22 versus the Milwaukee Brewers, Father’s Day at Kings Island, an evening at the Florence Freedom on Tuesday July 18 and August 8 for the City picnic at Summit Hills CC as recreational activities in the works at this time.

 

Communications – A newsletter was taken to the post office yesterday.

 

Building – The project is on schedule at this point and preliminary scheduling has indicated a move-in date of July 17 with a VIP dedication Friday August 25 and the general grand opening Saturday August 26.

 

After general discussion, motion to adjourn was made by Mr. Laird, seconded by Mr. Sommerkamp at 8:05 PM.
