REGULAR COUNCIL MEETING MINUTES

THURSDAY, MARCH 09, 2006

7:30 PM

 

CALL TO ORDER - With the Pledge of Allegiance and a silent prayer, Mayor Paul W. Meier called the meeting to order at 7:30 PM.

ROLL CALL - Present were Messrs. David Kramer, Ralph Laird, David Thiel, Thomas Moser and Tony Maschinot. Frank Sommerkamp did not attend.

APPROVAL OF AGENDA Agenda approved as submitted.

APPROVAL OF MINUTES – Regular meeting minutes of February 9, 2006.     Approved as submitted.

CITIZENS AND GUESTS

            Bonaventure Cahill was present.

MAYOR’S REPORT

1)     HB 661, which addresses storm water issues, goes before the Agricultural and Natural Resources committee to be heard Tuesday March 14 at 8AM.  Mayor Meier encourages elected officials to contact their respective legislators supporting the bill as written. 

2)     Municipal Govt. League of Northern Ky. will hold a meeting Thursday March 16 at the Wilder City Building.

City Administrator’s Report

1)     In phase I of the Dixie/Summit storm water project, in which the City of Crestview Hills is cooperating with the Kenton County Board of Education and the Kentucky Transportation Cabinet, reimbursement from the State of Kentucky in the amount of $100,000 has been received.

2)     The Chamber’s Government Forum will be held Friday March 10 at the Metropolitan Club.  The speaker is State Auditor Crit Luallen.

3)     The next project update meeting with CDS Architects and Endeavor Construction is scheduled for Tuesday March 21 at 10AM in council chambers.

4)     Mr. Groth and Mrs. Wirthlin are attending the Conference for Local Government Management in Lexington from March 29 – 31.

5)     An open house showcasing proposals for the Dixie Fix, which includes safety and transportation improvements from Covington to Florence, is to be held Monday May 8 at the Immanuel Methodist Church in Lakeside Park from 4 – 7PM.

6)     Street cleaning in Crestview Hills will take place March 21 and 22.

7)     The annual Crestview Hills volunteer appreciation dinner will be held at Summit Hills Country Club on Saturday December 9.

8)     The winter newsletter has been delivered to the post office and should arrive shortly at residences and businesses.

9)     The Ethics Committee will meet the third week in April.

10)  The Water District has scheduled a cleaning and repairing of lines along Rossmoyne to be completed between late spring and early summer.

 

OLD BUSINESS

 

None.

 

NEW BUSINESS

 

A.             Appointment to the Board of AdjustmentMayor Meier explained the departure of Lynn Hood from the Board of Adjustment to the Northern Kentucky Area Planning Commission.  Her spot is recommended to be filled by Bonaventure Cahill.   Motion to accept made by Mr. Kramer, seconded by Mr. Laird.  Ayes carried with an opposition by Mr. Moser.

B.             Ordinance 2006-3-1 – first reading of an ordinance to set down regulations for the keeping and control of animals within the city limits of Crestview Hills.  Mr. Kramer noted the discussion that took place in the Economic Development committee and pointed out that this ordinance parrots the Kenton County regulations.  Notable are provisions for micro chipping at the owner’s expense after an animal escapes, escalating offenses and fines, and conformity with Kenton County

C.             Ordinance 2006-3-2 - Mayor Meier desired further review of this ordinance to amend the sign ordinance on the recommendation of the Northern Kentucky Planning Commission and postponed first reading until the April Council meeting.

 

COMMITTEE REPORTS

Public WorksMr. Groth observed that the next committee meeting would not take place until April. City Engineer Jim Berling reported on the following:

 

Ø               Phase one of the Dixie Hwy. and Summit Drive storm sewer construction is completed.  The new piping network now crosses Dixie Hwy. and is completed to a point 120 feet up Summit Drive.  The balance of the job will be bid on March 15, 2006.

Ø               The storm water surface drainage problem at the intersection of Calumet and Lookout Farm Drive has been eliminated by constructing a new storm water drainage system in the area.  A few small items are not yet completed.

Ø               The Public Works Committee met with the Kentucky Transportation Cabinet to discuss problems and solutions to accommodate the new traffic that has been generated on Turkeyfoot Road since the opening of the Crestview Hills Town Center.

 

Fire and Safety – Mr. Laird noted that current and proposed contracts, boundaries, and pricing with Ft. Mitchell and Edgewood Fire Departments had been reviewed by the committee.  The review took place after a suggestion was made by Mr. Sommerkamp to change the coverage boundaries in the Research Park.  Mr. Laird stated that the committee agreed there would be no benefit in making a change at this time.  Motion to accept the committee’s recommendation made by Mr. Laird, seconded by Mr. Thiel.  Ayes carried.

 

Economic Development – Mr. Kramer informed council on the committee’s review of:

Ø            Sexually oriented businesses.  An update was discussed regarding opinions of Kenton County Attorney Gary Edmonson and the Northern Kentucky Area Planning Commission on the issue, although no formal decisions or recommendations have been made to date. 

Ø            Discussions have been held between Crestview Hills’ representatives and an interested party who desires the lot across from the City Building for the construction of a bank branch. 

 

CHEERMr. Laird reported on the last eve’s committee meeting in which advertising for requests for quotes from solid waste service providers was approved.  The current contract with Bavarian Trucking expires July 1.  After review of bids, a committee recommendation is expected next month.

 

RecreationMr. Maschinot recounted the Easter egg hunt on April 8 at Gloria Dei church but the City Building if inclement weather, the obtaining of the Party Deck for 2 Cincinnati Reds games on Saturday June 17 versus the Chicago White Sox, and Saturday July 22 versus the Milwaukee Brewers, Father’s Day at Kings Island, an evening at the Florence Freedom (date to be determined), and August 8 for the City picnic at Summit Hills CC as recreational activities in the works at this time.

 

Building – The project is on schedule at this point according to Endeavor Construction.  Mr. Moser desired comment and requested verbatim recording thereof.  It is as follows:

”            On Tuesday March 7th the building was inspected following the regular construction meeting.

A serious problem was noted regarding the electric installation.  All wiring is being installed in ½” metal clad 2 conductor cable.  This means that any change to the electric system would require cutting of walls and ceiling rather than simply pulling new wires through a conduit system.

Tim Greene of CDS architects was contacted regarding this situation. (It should be noted that during the plan review the absence of electrical specifications was noted as an omission in the construction documents.  His response at that time was simply that “There are none.”)  CDS was and is responsible for the electrical design as it was to be done in house rather than contracted out as was the HVAC and plumbing design.

Mr. Greene’s response to the problem was that it was being installed according to code.  Mr. Greene was told that we could get an installation according to code without paying a design fee, and that “according to code” is the absolute minimum installation and is unsatisfactory for the quality building that Crestview Hills contracted for and that CDS proposed to design.

Mr. Greene was told that the installation is not acceptable and that the City of Crestview Hills is expecting a written response to this complaint and a correction of the situation by CDS since it is because of their oversight that this has occurred.”
